These Terms and Conditions ("Terms") govern your use of the ElderAIssist website (elderaissist.com), the ElderAIssist assisted living management platform, and the ElderAIssist Family Alerts text messaging program. By using our services or opting in to receive text messages, you agree to these Terms.
1. Program Name and Description
Program Name: ElderAIssist Family Alerts
Description: ElderAIssist Family Alerts is a text messaging service operated by ElderAIssist (a TenantryFi product) on behalf of participating assisted living facilities. The program sends SMS notifications to authorized family members of facility residents, including daily wellness summaries, incident alerts, care updates, appointment reminders, and facility announcements. Messages are informational and transactional in nature — they are not marketing or promotional messages.
2. Consent and Opt-In
By providing your mobile phone number and checking the consent box on the facility's family enrollment form (either in person or through the ElderAIssist family portal), you expressly consent to receive text messages from ElderAIssist Family Alerts on behalf of your loved one's facility. Consent is not required as a condition of purchasing any goods or services.
3. Message Frequency
Message frequency varies based on your notification preferences and facility activity. Typical usage is 1–5 messages per day, which may include a daily wellness summary, incident notifications (if any), and occasional facility announcements. You may receive additional messages if there is a health event or incident involving your loved one. Message frequency will not exceed 10 messages per day under normal circumstances.
Message and Data Rates: Standard message and data rates may apply depending on your mobile carrier and phone plan. ElderAIssist does not charge any fee for the text messaging service itself. Contact your mobile carrier for details about your messaging plan.
4. Opt-Out Instructions
You may opt out of receiving text messages at any time.
To opt out, reply STOP to any message you receive from ElderAIssist Family Alerts. You will receive a single confirmation message confirming that you have been unsubscribed. After opting out, you will no longer receive text messages. You may re-enroll at any time through the family portal or by contacting your loved one's facility.

6. Supported Carriers
ElderAIssist Family Alerts supports messaging on all major U.S. mobile carriers, including AT&T, Verizon, T-Mobile, Sprint, and their subsidiaries. Carriers are not liable for delayed or undelivered messages.
7. Use of the Platform
The ElderAIssist platform is provided to assisted living facilities and their authorized users (staff and designated family members). By using the platform, you agree to:
- Use the service only for its intended purpose of managing resident care and family communication.
- Keep your login credentials secure and not share them with unauthorized persons.
- Provide accurate information when registering or enrolling.
- Not attempt to access resident data you are not authorized to view.
- Not use the platform for any unlawful or harmful purpose.
8. Privacy
Your use of ElderAIssist is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. We do not sell or share your personal information with third parties for marketing purposes.
9. Intellectual Property
All content, features, and functionality of the ElderAIssist platform — including text, graphics, software, AI models, and design — are owned by TenantryFi, Inc. and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our platform without written permission.
10. Disclaimer of Warranties
ElderAIssist is provided "as is" and "as available." While we strive for accuracy, AI-generated wellness summaries and clinical insights are informational and should not be considered medical advice. Always consult with facility staff or a healthcare provider for medical decisions. We do not guarantee uninterrupted or error-free operation of our services or text message delivery.
11. Limitation of Liability
To the maximum extent permitted by law, ElderAIssist and TenantryFi, Inc. shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our services, including but not limited to delayed or undelivered text messages, inaccuracies in AI-generated content, or service interruptions.
12. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Your continued use of our services after changes are posted constitutes acceptance of the updated Terms. If material changes are made to the text messaging program terms, we will notify enrolled users via text message.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Colorado, without regard to conflict of law principles.
